What is the ruling if the girl does not give permission at the time of marriage?
If the girl is an adult and did not know about this marriage beforehand and the father married her without permission, then the moment the girl got the news, she had the right to refuse. It is in Hadith Sharif. That is, when the girl got the news of the marriage and she remained silent, this is the proof of her consent. Although the Holy Qur'an has empowered the wise man.
لَاجُنَاحَ عَلَیْکُمْ فِیْمَافَعَلْنَ فِیْ اَنْفُسِہِنَّ مِنْ مَّعْرُوْفٍ(سورہ بقرہ:۲۴۰)
(So you are not impeached for what they did properly in their case)
If it is allowed to laugh or cry silently (this is permission) and if it is allowed to cry with a voice, it is neither permissible nor rejected. If she agreed after that, then the marriage was solemnized. It is like this in Mi'raj. Qazi Sahib wanted that when Hinda was an adult, he should have taken her permission to perform the nikah, but he sent Bakr and performed the nikah on his statement, and the marriage took place. But in crying slowly, the woman does not have the option of annulment, and if she cries aloud, then after the marriage, the right to rescission is obtained, that too at the same time. After some days, if she wants to cancel the marriage on the basis of any other excuse, then it is not permissible۔
